Procedural Compliance & Execution

Secured Funds Trading Procedures.

Defined protocols and strict compliance steps required for client qualification, asset verification, funds blocking mechanisms, and trade commencement with Tier-1 international platforms.

01
Phase One

Analysis and Assessment

Our team of financial and legal experts will at all times be responsible for advising the client professionally in a detailed and personalized manner. Depending on the client’s assets, each case will be assessed independently and the best way to proceed with the transaction will be proposed with the key intention of completing the transaction successfully and in the best interests of all involved.

We welcome personal visits by clients to our numerous offices globally as we believe that face-to-face meetings are a more conducive way of conducting mutual business opportunities.

Compliance Pre-Requisite: Entry into an SFT by any client requires a process of compliance and acceptance of such client / investor by the trade group. All documentation must be completed timeously and correctly by investors. Failure to disclose any required information, or incorrect disclosure of such information, will lead to rejection by the compliance officer and accordingly exclusion from entry into an SFT.
02
Phase Two

Documentation Required and Submission

In order to be accepted into an SFT, all potential clients are required to provide the following compliance documentation to City Capital Traders for on-send to the selected Trade Platform offices:

1. Joint Venture Agreement / Consulting Mandate

Formal bilateral agreement executed between CITY CAPITAL TRADERS and client setting forth transaction parameters, upfront negotiated fees, and non-circumvention terms.

2. Client Information Sheet (CIS / KYC Package)

Completion by client of an official CIS package. This is a standard Information Sheet covering pertinent information on the client plus a copy of client passport.

Corporate Signatories: In the case of a company/trust, a corporate resolution must be completed with the name of the person who is the authorized signatory for the company (plus passport copies of authorized company representative). In certain instances, a client may also be asked to provide a summary as to the history of funds.

3. Proof of Funds (POF) Standards

In the case of cash in client account, the POF must be current (less than 3 days old). The POF demonstrates that the client has capacity to enter the program and allows the Trading Group/Bank to conduct due diligence to ensure funds are good, clean, clear, un-encumbered funds of non-criminal origin.

Acceptable Format A: A duly signed letter of comfort from the client’s bank stating that the client is known to the bank, is of good standing with the bank, and holds sufficient unencumbered funds on account with said bank.
Acceptable Format B: A copy of the client’s current dated bank statement duly signed by 2 authorized bank officers managing the client’s account.

4. Bank Instrument Draft or RWA Letter

Where an instrument is utilised by a client, a draft copy of the instrument must be supplied or an RWA (Ready Willing and Able) letter from the issuing bank stipulating their intent to issue such and the proposed verbiage of the instrument to be issued.

STRICT NON-NEGOTIABLE REQUIREMENT: We do NOT accept any procedures that prohibit telephone calls bank to bank, since this is necessary in order to verify and ensure that we are dealing with the qualified signatory of the account and that instruments are not “leased”.
03
Phase Three

Due Diligence and Asset Verification

Once the documentation is submitted, the Trade office will immediately proceed with the verification of the funds or instrument.

Zero Tolerance Compliance Filter: Any funds connected with criminal activities, drug trafficking, weapons, or any other form of illegal activity will not pass through compliance, and all parties connected thereto will be prohibited from any trading whatsoever.
04
Phase Four

Program Manager Contact & Funds Blocking

Once a client has passed through compliance successfully, the Program Manager will contact the client directly via telephone to formally present the proposed trade program to the client, discuss proceeds/returns generated, and agree on the method of ‘blocking’ client funds or monetizing instruments.

Available Options for Blocking Cash Funds

Option 01 Global Scope

Swift MT-799 and MT-760

Where the client’s bank issues a Swift MT-799 prior notice and a Swift MT-760 lock to the bank the Trader appoints on the trade contract. The recipient bank of the MT-760 will be the Trader’s Company.

Characteristics: Incurs bank issuance costs for the client, but remains directly under the control of the Trader.
Option 02 Option Only in Europe

Authorization to Manage Account

The client authorizes the Trader as a signatory to indistinctly manage the account where funds are deposited, with the EXCEPTION of transferring funds from the account. The Trader’s intervention at the client’s bank is solely and exclusively to request a letter to block the amount of invested funds.

Characteristics: Client remains the ONLY signatory allowed to move funds. More economical; avoids Swift issuance fees and bureaucratic delays.
05
Phase Five

Execution of Trading Agreement

After the client and the Program Manager agree on a preferred option for blocked funds, the client is provided with the official contract / prospectus from the Trading Group for review, queries and acceptance.

Digital Signature via Encrypted Email

Fast, secure, and authenticated electronic execution of the contract package.

In-Person Signing

Client and Trader meet face-to-face at an agreed date, time, and global office location.

Timeline to Commencement: Once the Trading Contract is signed by both parties and assets are blocked for the duration of the trade period (normally 12 months, with possible rollovers), the client will formally be submitted into the program within a maximum of 15 banking days, and the trade will commence according to contract terms.
06
Phase Six

Yields / Proceeds Disbursement

The Trade proceeds will be in accordance with the signed Trade agreement, payable timeously and as per the terms and conditions thereof. Yields are collected weekly or monthly, depending on the structure of the Trade.

Trade Paymaster & Notary Governance

For the duration of the Trade Program, the proceeds will be collected into the appointed Trade Paymaster / Notary account and transferred to the client’s nominated account through the City Capital Traders account.
